Sexual Harassment Training

California AB 1825 requires employers with employees in California with 50 (W-2 and/or 1099 individuals) or more employees and/or contractors to provide all managers, supervisors, leads, or anyone giving input to management, with two hours of interactive sexual harassment training by 1/1/06. Beginning January 1, 2006, sexual harassment training must be ongoing for all supervisors within six months of becoming supervisors, whether hired or promoted. Supervisors must also receive at least two hours of anti-harassment training every two years.

On April 23, 2007, the Fair Employment and Housing Commission (FEHC) adopted revised regulations, including tighter requirements for AB 1825 trainers. These new provisions stipulate that training must be provided by:

“Human resource professionals with two or more years practical experience in one or more of the following:
a) designing or conducting discrimination, retaliation and sexual harassment prevention training;
b) responding to sexual harassment complaints or other discrimination complaints;
c) conducting investigations of sexual harassment complaints; or
d) advising employers or employees regarding discrimination, retaliation and sexual harassment prevention.”
