Reasonable Suspicion: Drugs, Narcotics & Alcohol

There's been a significant increase in restaurant reporting concerns with employees involving drug, narcotic or alcohol use. As a supervisor, manager, or restaurant owner, do you know what to do LEGALLY if:

  • An employee shows up to work under the influence;
  • You receive a report that an employee has illegal drugs in their locker or on their person;
  • An employee wants "reasonable accommodation" under the American with Disabilities Act (ADA) for their alcohol or drug dependency;
  • An employee shows up with a medical marijuana certificate;
  • You want to terminate an employee for their drug use;
  • You want to prove a case to terminate (or even send home) an employee suspected of being under the influence;
  • An employee gets injured on the job and you suspect they are under the influence of drugs or alcohol; and
  • An employee wants to exercise their rights under Workers' Compensation, Unemployment, Disability and FMLA when drugs are involved.
